You have the right to utilize my art in content creation including: Live Streaming, Vtubing, Online Videos or Shorts, as well as non profit recreational use. You may neither sell nor exchange my art in any form, physical or digital, print or NFT, under any circumstances unless you have my express written permission AND you have paid for the rights to do so. Under no circumstances are you to use my art in AI training, datasets, or any other image generating software. To use my artwork in any game, animation, or any other creative project not listed above please contact me and we can come up with a separate arrangement.
When using or sharing my art online you must credit me. You can link either my website, my bluesky @witthoeft.art, or my Vtuber bluesky @CaptainNovaVT
Payments will be done incrementally at the start of each Milestone of the project. You will receive an invoice via PayPal and once payment is received I will start working on that phase of the commission.

You can modify your commission at any time before I start working on the piece.
Once I've started working I am happy to do minor modifications within reason. I'll often share progress to ensure the model is coming along to your specifications. Larger changes may require additional fees, or a new commission.
In regards to refunds: If one is needed I will refund 50% of the current milestone's payment. Once a milestone is reached that payment is nonrefundable. If a refund is requested I will send you the file of the most recently completed milestone. I will not send 'in progress' files.
I have the right to refuse any commission for any reason. I have the right to terminate an in progress commission, In those instances I will refund any in progress milestone fully and I will send you the file of the most recently completed milestone. I will not send 'in progress' files.
I have the right to share both in progress and finished works online via social media, video, livestreams, and my personal portfolio. I am willing to keep models 'secret' until a Vtuber's debut/redebut (or after a reasonable amount of time has passed) for an additional fee however.
I have the right to Update or Change these Terms of Service as I see fit
Things such as height, gender, personality and anything that will help me understand the character better
A model sheet of your character in the 'T-pose' or 'A-pose' is required with AT LEAST a Front and Side view. In lieu of that, reference images can be provided and I will make my own model sheet for an additional fee. If you need me to design a character for you we can discuss that as well.
I will contact you with updates via email and prefer to have all communications done through that. Thank you for understanding
